Deed Restrictions

  1. Unless agreed upon by 100% of the property owners in this division, this property is restricted against future dairy operations, commercial confined poultry or swine operations.
  2. All lots subject to utility easements as recorded on the plat and future right of installation and maintenance of any utility as required. No fee may be collected by any landowner in exchange for future utility easement. There is a twenty foot utility easement along the northern side of the McQueary Road Extension for future installation & maintenance of utilities.
  3. Developed lots and tracts shall comply with all state and local health and sanitation laws.
  4. Minimum building setback to be thirty (30) feet on the front lot lines and ten (10) feet on all other sides.
  5. No lot shall be divided into smaller lots unless all resulting lots are in excess of 1acre m/l. All resulting lots will be subject to the same restrictions as the original lot.
  6. Any residential structure erected or placed on any lot shall contain at least 1,000 square feet of heated floor space.
  7. All homes must have a solid permanent perimeter foundation.
  8. The exterior finish of the primary structure as well as secondary detached buildings shall be of brick, rock, stone, vinyl, aluminum, exterior wood, or log.  New painted metal may also be used for outbuildings. Existing buildings are excluded.
  9. It shall be the duty of the owner of each lot to keep the grass on the lot property cut and to keep the lot free from weeds and trash, and otherwise neat and attractive in appearance. Land in use for hay or similar crops are the exception, however, it must be harvested in a reasonable time. No property shall be used for trash storage, junkyard or landfill purposes.  Property is also restricted against mobile home parks.
  10. Manufactured housing - including single, double, or modular homes - are permitted, but homes must meet the minimum square footage requirement, solid perimeter foundation requirement, be kept clean and neat in appearance and no older than three years of age at time of placement on the property.  
  11. McQueary Road Extension is dedicated to public use and subject to the roadway agreement.
  12. These restrictions may be modified or null and void if 100% of the property owners in this division agree to do so in writing and have recorded in the Russell County Clerk’s Office.
